Constitution
1. TITLE AND OBJECTS. The Club shall be known as the Tarporley and District Angling Club (hereinafter called the Club). Its object is to promote Angling for the benefit of Tarporley and surrounding area. The Club shall consist of President, Chairman, Vice Chairman, Secretary, Treasurer, Management Committee and Members. The Chairman in all disputes to give the casting vote. The Financial Year will end on the 15th March in each year.
2. MEMBERS OBLIGATIONS. All Members and other persons Fishing Club waters or taking part in any activity organised by the Club must conduct themselves in a fair and sporting manner, and must show consideration and respect for Fish and other Wildlife, Crops, Vegetation, Property, Fellow Anglers, other Water users, Local Residents, Landowners or any other persons. In particular Club Rules must be scrupulously observed, but in any situation not specifically covered all persons will be expected to act responsibly. The advice or ruling of any Club Bailiff or Officer must be observed immediately, even if disagreed with. Any objection to such a ruling should be made to the Secretary in writing and signed, within seven days for consideration of the Management Committee. Members who are aware of infringements which they are unable to prevent are responsible for ensuring that these are reported to a Club Official. The Management Committee is empowered to take whatever action it deems appropriate against offenders.
3. ANNUAL GENERAL MEETING. An Annual General Meeting of All Members will be held annually during April of each Year to hear reports of the running of the Club, adopt Balance Sheet, Elect Officers and Members of the Management Committee. The management committee can, if it feels there is the need, call a Special General Meeting (SGM) of all the members to discuss possible changes to the constitution.
4. MANAGEMENT COMMITTEE. The Management Committee shall consist of the club President, Vice Presidents, Chairman, Vice Chairman, Secretary, Treasurer, I.T. Manager, Match Secretaries and other Members. All Officers of the Club and Ordinary Management Committee Members shall retire annually, but shall be eligible for re-election. The Management Committee shall meet a minimum of four times a year, and shall transact all business of the Club and its decisions shall be final. All club Trustees and bailiffs are welcome to attend these meetings. 5 will form a quorum.
(A) This year we have introduced 2 open Members Positions so they can understand and share what is discussed. There will be an invite 2 weeks before the Committee Meeting for members who would like to attend.
5. MEMBERSHIP. The Club numbers shall be up to a maximum of 400 members who shall consist of the following:
(A) FULL MEMBERS. Who must be over 16 years of age
(B) SENIOR MEMBERS. Full Members who have reached the age of 65 years and who have been a member for 3 consecutive years.
(C) HONORARY MEMBERS. Full Members who have given distinguished service as a Club Official or Committee Member may be appointed Honorary Members. Such appointments are at the sole discretion of the Management Committee. (Senior and Honorary Members have all the rights of Full Members).
6. APPLICATION FOR MEMBERSHIP. No Application for membership shall be considered without a written Application Form duly signed by a Proposer and Seconder. Any Member wishing to propose someone for Full Membership may do so at any time and as often as they like by obtaining an Application Form from the club web page, or from the Secretary by mail or post. Each Application Form will be dated and vetted by the Secretary for entry into the Club, or for addition to the waiting list. Applicants who are unable to provide a proposer or seconder may be permitted to join the Club if they can obtain a written reference from another Angling Club. All applicants must live in Cheshire. Face to Face New Member Interviews are now allowed.
7. SUBSCRIPTIONS. The Management Committee will fix the joining fee and Subscriptions Annually.
A Senior Member will pay not less than half the Subscription fee of a Full Member. Membership Cards will be issued by the Secretary by Post after 1st May in each Membership year, once the payment has been made. Members who have not re-joined by the end of June in each Membership year will be regarded as having terminated their Membership. Honorary Members and Members who receive complimentary Membership will receive their Membership Cards in May of each year.
8. AMENDMENTS TO THE CONSTITUTION. The Constitution may only be altered by the AGM provided a statement signed by the Proposer and Seconder clearly stating the proposed amendment and is in the Secretary’s hands by March 14th. This proposal must be circulated to all Members prior to the AGM.
9. AMENDMENTS TO THE RULES FOR FISHING. Rules for Fishing may be amended at any time by the Management Committee, in the event of this happening, all Members are to be notified in writing or by email.
10. POSTAL BALLOTS. No Postal Ballots are allowed.
11. CLUB WATERS. Club Waters may be fished all the year round.
12. USE OF WEEDKILLER. No Weed killer other than “Roundup may he used on Clubs Waters.”
13. DISCIPLINARY PROCEDURE. Members of the Club whose conduct is inappropriate or who declines to abide by any of the Rules or Bylaws of the club, this also includes the club FaceBook page, may be expelled or suspended at a Meeting of the disciplinary Subcommittee, where their subscriptions may be forfeited, Members shall have the right to appeal in person to the Senior Management Committee, which consists of the club Chairman and the club Secretary, with regard to any decision affecting themselves, provided that notice of such an appeal is submitted to the club Chairman in writing, within seven days of the notification of the decision by the disciplinary subcommittee.
14. DISCIPLINARY SUBCOMMITTEE. The Disciplinary subcommittee will be made up of 3 members of the management team. Ideally including the Vice Chainman, but this would the subject to his availability.
15. DISSOLUTION. If at any General Meeting of the Club a resolution be passed calling for the dissolution of the Club, the Secretary shall immediately convene a Special General Meeting of the Club to be held not less than one Month thereafter to discuss and vote on the resolution. If at that Special General Meeting the resolution is passed by at least two thirds of the members who are entitled to vote and are present at the meeting the Management Committee shall thereupon, or at such a date as has bean specified in the resolution proceed to realise the assets of the club and discharge all debts and liabilities of the club. After discharging all debts and liabilities of the club the remaining assets shall not be paid or distributed amongst the members of the club but shall be given or transferred to some other voluntary organisation having objects similar to those of the club.
18. TRUSTEES. The assets of the club including land, buildings and fisheries shall be vested in club trustees. These trustees will hold office until death, resignation or removal from office. The removal from office and the appointment of trustees, Shall be made by the officers of the club and will be subject to confirmation by the management committee of the club.
17. HONORARIUMS. The club Honorariums will be reviewed by the Management Committee annually and the payments set.
